1. Information We Collect

When you use Waiter.ng, we may collect the following information:

• Account data: Name, email address, phone number, and password when you register as a customer or restaurant owner.
• Order data: Menu items ordered, table numbers, order history, tips, and associated timestamps.
• Payment data: Wallet balances, top-up and withdrawal records, and bank account details for restaurant payouts. Card payments are processed by Paystack and we do not store card numbers.
• Device and usage data: IP address, browser type, pages visited, and session duration for security and service improvement.
• Restaurant data: Business name, address, menu items, staff accounts, and operational settings.

2. How We Use Your Information

• Process and fulfil food and drink orders between you and partner restaurants.
• Manage wallet top-ups, payments, tips, and withdrawal requests.
• Provide real-time order tracking and kitchen management tools.
• Send transactional notifications (order confirmations, email verification, receipts).
• Improve our platform, detect fraud, and maintain service security.
• Comply with Nigerian data protection laws and regulations.

3. Data Sharing

We share data only when necessary:

• With partner restaurants: Order details, table info, and customer display names so they can fulfil your orders.
• With payment processors: Paystack processes payments on our behalf. They have their own privacy policy.
• With email service providers: We use Brevo (Sendinblue) for transactional emails (welcome, order receipts, email verification).
• Legal requirements: When required by law or to protect our rights, safety, or property.

4. Data Security

We implement industry-standard security measures including HTTPS encryption, secure session handling, CSRF protection, HTTP-only cookies, and database-level row-level security (RLS) to isolate restaurant data. Passwords are hashed using Django's password framework and are never stored in plain text.

5. Data Retention

We retain your account data for as long as your account is active. Order and transaction records are kept for a reasonable period to comply with financial regulations and to handle disputes. You may request deletion of your account by contacting us at support@waiter.ng.

6. Your Rights

Under the Nigeria Data Protection Regulation (NDPR), you have the right to:

• Access your personal data held by us.
• Request correction of inaccurate data.
• Request deletion of your personal data.
• Withdraw consent for data processing.
• Lodge a complaint with the relevant data protection authority.

7. Children

Waiter.ng is not intended for use by anyone under the age of 18. We do not knowingly collect data from minors.

We may update this privacy policy from time to time. Material changes will be communicated via email or a notice on our platform.

1. Acceptance of Terms

By accessing or using Waiter.ng ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Service Description

Waiter.ng provides digital menu management, QR-based ordering, kitchen management, and payment processing tools for restaurants, bars, and lounges in Nigeria. We act as a technology intermediary between diners and hospitality venues.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• One person may not maintain multiple customer accounts.
• Restaurant owner accounts require valid business information.

4. Orders and Payments

• Orders placed through Waiter.ng are binding once confirmed and debited from your wallet.
• All prices displayed on menus are set by the restaurant and include applicable taxes as configured by the venue.
• Wallet top-ups are processed via Paystack and are non-refundable except where an order is cancelled in accordance with the restaurant's policy.
• Cancellation refunds are credited back to your Waiter.ng wallet, not to the original payment method.
• Tips are voluntary and are paid directly to the waiter through the platform.

5. Restaurant Owner Obligations

• You must ensure menu items, descriptions, and prices are accurate and up to date.
• You are responsible for the quality, safety, and timely preparation of food and drinks.
• You agree to honour all confirmed orders unless a cancellation is processed via the Platform.
• Staff accounts you create are your responsibility. You must revoke access when staff leave.

6. Subscription Plans and Billing

Access to restaurant management features on Waiter.ng is governed by the following subscription tiers:

• Free Trial: New restaurant owner registrations are automatically placed on the Free plan. The Free plan is valid for 7 days from the date of registration and is limited to a maximum of 50 orders. No payment is required for the Free plan.
• Solo – ₦50,000/month: Grants access to unlimited orders, unlimited menu items, and 1 restaurant. Billed monthly.
• Enterprise – ₦100,000/month: Grants access to unlimited orders, unlimited menu items, and up to 3 restaurants. Billed monthly.

• Subscription payments are processed securely via Paystack. By initiating a subscription payment, you authorise the charge to your selected payment method.
• Subscriptions are activated upon successful payment verification and are valid for 30 calendar days from the date of activation.
• Subscriptions are not automatically renewed. Owners are responsible for renewing their subscription before it expires.
• Payments are non-refundable except where required by applicable Nigerian law or in cases of documented platform error.

7. Subscription Expiry and Access Restrictions

• When a subscription expires (or the Free plan's 7-day or 50-order limit is reached), the following restrictions apply automatically:
  • The restaurant's public menu and QR-based ordering interface will be suspended, preventing new customer orders.
  • All waiter and manager accounts associated with the restaurant will lose access to their dashboards until the subscription is renewed.
  • The restaurant owner retains full access to their owner dashboard and the subscription page to facilitate renewal.
• Restaurant data (menus, order history, staff accounts) is retained for a reasonable period after expiry and is restored upon renewal.
• Waiter.ng is not liable for any business disruption caused by subscription expiry.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Attempt to gain unauthorised access to other users' accounts or our systems.
• Submit false or fraudulent orders or payment information.
• Abuse the cancellation or refund system.
• Scrape, reverse-engineer, or interfere with the Platform's operation.

10. Intellectual Property

The Waiter.ng name, logo, design, and software are the intellectual property of Waiter.ng. Restaurant owners retain ownership of their menu content, branding, and photos uploaded to the Platform.

11. Limitation of Liability

Waiter.ng is a technology platform. We are not responsible for the quality, safety, or hygiene of food and drinks prepared by partner restaurants. We are not liable for losses arising from restaurant errors, delayed orders, or payment processing issues outside our direct control.

12. Termination

We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk to the Platform. Restaurant owners may close their accounts at any time after settling outstanding balances.

13. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved in the courts of Lagos State.

14. Changes to Terms

We reserve the right to modify these terms. Continued use of the Platform after changes constitutes acceptance of the updated terms.

Cookies are small text files stored on your device when you visit a website. They help us remember your preferences and keep you signed in.

Essential Cookies (Required)

• Session cookie (sessionid) — Keeps you logged in and maintains your active table and restaurant context. Expires after 12 hours of inactivity.
• CSRF token (csrftoken) — Protects against cross-site request forgery attacks. Required for all form submissions.

Functional Storage

• Session storage — Stores temporary state such as whether the landing page loader has been shown during this browser session.

3. Third-Party Cookies

• Paystack: May set cookies during the payment top-up flow for fraud prevention and transaction processing.
• Google (optional): If you sign in with Google, Google's own cookies apply per their privacy policy.

4. No Tracking or Advertising Cookies

Waiter.ng does not use tracking pixels, advertising cookies, or analytics services that track you across websites. We do not sell or share cookie data with advertisers.

5. Managing Cookies

You can clear or block cookies in your browser settings. Note that blocking essential cookies will prevent you from logging in or placing orders on the Platform.
